A must read for those who wish to establish and chart the development of philosophy from the "Natural Law" idealists of the 18th century (Locke, Rousseau), and the Benthamite/Mill Social utilitarians to more contemporary phenomenology and existential thought without being bogged down or becoming an apostle of the great "systemic philosophers of society (Leibniz, Hegel, Marx, Spencer). Who would expect such a refreshing read that breaches the borders of legal theory, historical development of the language of law from the Romans to the German volksgeist , and a worthy and interesting adaptation of Benthamite "egoism" as the basis for society's laws, the powers of the state in historical context and the relativist development of moral "science". Attacked on its publication by purists, progressivists and marxists for its relativism and lack of adherence to any external a priori imperatives of legal form or moral behavior, I find Von Jhering to be an absolute tonic to the muddy ground of Hegelian "synthetic" history and Marxist false, finalist categories of class and class "warfare". I am pissed in retrospect that the Zweck im Recht does not have a place higher in the US University canon of books that must be read by those that would be considered schooled. I learned as much from this decidedly middle-brow German jurist as I did from wading through Kant's categories, and you will, too. There are some bizarre archaic and provincial inanities in examples and socially accepted givens, but the text is remarkably free of religious "revelation" or dependence on much beyond linguistic attention and a phenomenological bent. Recommend this one as a must read for the discerning. Must read: no lie. Lacking this one will impoverish you.

Outdated and often factually inaccurate. It is obvious why this is a free read. Disappointing but not surprised
