Review # 1 was written on 2016-11-05 00:00:00 Marian Sly Posner compares Bush v. Gore favorably with the Emancipation Proclamation and the Korematsu decision (188). Posner is a pragmatist in the Jamesian mold---"looking towards last things, fruits, consequences, facts," instead of towards ideological principles or political necessities and niceties. Consequently, his views have an occasional inflammatory tinge. Here, he positions Bush v. Gore as a case decided (on a likely inadequate Equal Protection Clause argument) to avert an intractable Constitutional crisis. I wish Posner was more descriptive in his treatment of the decisions at both the Florida and the United States Supreme Courts. Absent basic explanations of those courts' decisions, Posner's arguments can be difficult to follow.

Review # 2 was written on 2012-01-16 00:00:00 Navinchandra Mehta Though a bit dry, does provide some interesting arguments as to why the US Supreme Court ultimately made the right decision to stay the vote in the 2000 Gore-Bush election, mainly that the election would ultimately go to Congress, creating more havoc. Posner seems to be quite a Constitutional scholar, and thats a good thing.
