LIGHT AT THE END OF THE CAPACITY TUNNEL! Since the first edition of this book appeared in 2005, substantial regulations have been made to bring the Mental Capacity Act 2005 into force. Some Codes of Practice have now been published to help practitioners interpret the Act and those draft forms are included here for the first time. So, this Law Society guide gives us an important additional section on the protective jurisdiction of the Court of Protection concerning the deprivation of liberty of patients in hospitals and care homes, and is most welcome. Then the Mental Health Act 2007 inserted major provisions into the existing legislation to close the ‘Bournewood gap’ following the decision in HL v the United Kingdom. Subsequently, a new Deprivation of Liberty Safeguards Code of Practice is being introduced to supplement the main Code we have. Practitioners Greaney, Morris & Taylor have usefully examined the relationship between the statutory regimes of the 2005 Act and the earlier 1983 Act to great effect in the guide. So its value is that the authors have been able to anticipate difficulties following commencement of the provisions of the new 2007 Act in the hope that these difficulties will fall away once we get use to the legislation. The second edition of this popular guide to the law of mental capacity is a most welcome addition to our mental health law library (of which there are still relatively few books) setting out the provisions as they now stand because the law and procedures have greatly expanded the current issues we face, giving clear explanations and analyses from three experienced practitioners who cover all the changes in statute, case law and guidance since the Act gained its Royal Assent with great clarity. This book conveniently includes the full text of the Mental Capacity Act 2005, as amended by the Mental Health Act 2007, and the text of the two Codes of Practice. The law is stated as at 1st July 2008 and, as Sir Mark Potter says in his Foreword, it’s a comprehensive ‘vade mecum’ – a book for ready reference regularly carried by practitioners in this field having been produced at just about the right time as we come to grips with the new system of rules: it gives us light at the end of the capacity tunnel. Good bio. Same author wrote "Lennon". This one is in the same vein. Obviously Coleman likes Eric Clapton so it is a bit of a love fest. Still has all the events of his life. Good read.
