Despite the enormous progress made in recent years towards the liberalization
of some of our more puritanical laws governing what a person may view or read,
the struggle for complete freedom of expression is far from over. Local ordinances
are still being created with the express purpose of banning materials which in
many cases have already been sanctioned by higher courts and authorities. Lawyers
and judges still struggle to define such terms as "lewd conduct," "obscenity"
or "pornography."
At this point it is still possible to be arrested for nude bathing even if no
one complains or is offended, and it is still possible for a military official
to be censured for allowing his men to be entertained by something as innocuous
as a topless dancer.
Every time one of these incidents takes place, every time a newsstand is closed
or raided or a radio station forced to change its format, the forces of censorship
have won another round in their efforts to dictate to people what they are allowed
to do, see or read. We are an open enough society so that these acts cannot be
performed in secrecy. The news media generally keep the public well informed about
such infringements upon individual freedom, but it is up to the public to respond
and protest whenever these incidents occur. No amount of reporting by the press
will block the activity of the censors; only the loud protest of people whose
rights have been violated can possibly check the activity of elements seeking
to throttle the current movement toward greater freedom of sexual expression.
The average individual will become extremely vocal if he feels he has been taxed
unfairly and expects to have his complaints listened to. In the same sense, he
should fight for his other rights. The elected officials who represent us and
who are paid by the taxes we pay are there to listen to their constituents, and
it is their duty to fight to right any wrong generated by censorship agencies
which violate the spirit of the law. You as an individual have rights guaranteed
by the Constitution, but you can only retain them if you sound off loud and clear
whenever they are being trampled upon.
