BULLSHIT!
The City of Hamilton has an anti-porn bylaw. As of May, 1978, all magazines that, "appeal, or are designed to appeal, to erotic or sexual appetites" have to be covered in opaque plastic wrappers and must be kept at least five and a half feet from the floor. Furthermore, any store owner or operator selling such material in Hamilton must apply for a license to run an adult entertainment parlor, at a cost of $15.
Now that bylaw is currently being disputed in the courts and Morris Perozak, a lawyer representing 16 of Hamilton's 250 variety stores, asked Mr. Justice Anthony Maloney of the Supreme Court to issue a restraining order. Keep the City of Hamilton from laying any further charges while the law is before the courts.
That's a reasonable request, one that is routinely made in this situation. The judge seemed to think so, too, but listen to his reply. He would not issue the restraining order because the bylaw affects too many stores, but, "I would be disillusioned if a responsible corporate entity like the City of Hamilton prosecuted someone if the enabling legislation was under attack."
Somebody ought to wise up the judge. At least, I hope he needs wising up. I'd hate to think he made that statement in a spirit of total cynicism.
You see, there's an attitude behind that statement, the attitude that the law is a thing to be respected in the spirit as well as the letter. It's the attitude that says the law is above greed and partisanship and petty politics and that a "responsible corporate entity like the City of Hamilton" obeys the law and enforces it in a spirit of pure, evenhanded justice.
It's bullshit! The law, whether you know it or not, is a tool. It can be, and routinely is, used to get at people, to do people favours, to line pockets and to further careers.
And this isn't an accident. It isn't misuse of the law by unscrupulous governments and cops. It's built right into the system.
Talk to somebody in the restaurant business. Those people operate under federal, provincial and municipal regulations and often with more than one department at any of those levels. They're faced with a situation where they're always in violation of something. They have to be, because if they comply with the federal rule, they're automatically in violation of the local one. If ever the cops or the politicos want to shut down a particular restaurant, there's always something they can get them on.
Here's a case in point: The Roxy Theatre, here in Toronto, runs a movie called The Rocky Horror Picture Show every Friday and Saturday midnight. Its big with teens; some have seen it dozens of times. But there's a lot of funny sex in it and it's Restricted. Now, the Roxy tries to keep out the under-agers, but that's an impossible chore, so what happens? The Theatres Board sends around its inspectors. If they can't find any under-age kids, they hassle about the fire exits, the washrooms, the projection booth and anything else they can find. They slap a wrist or two and maybe slap on a fine. Then they split, only to return again next week. Result: The Roxy may have to give up the most profitable picture they've ever booked and the teens are prevented from hanging out in a big group.
That's law used by those in power to accomplish their own ends and, if you still don't follow me, here, from the Hamilton city solicitor's office, is David Vickers comment on the judge's ruling: "Off the record we just may lay further charges."
