BANKRUPTCY AND RELATED LAWS is the successor to Cases and Materials on Debtor and Creditors. Although much of the material is new, the authors' basic approach to teaching materials is unchanged. Both the new material and the cases and problems retained from Debtors and Creditors are designed so that a student can learn the "basics" prior to class by reading the cases and notes and working through the problems. All of the problems can be "answered" (to the extent that the problems have answers) from materials already covered in the book.
There are new cases, new text, new problems and new kinds of materials. In addition, materials on traditional state collection remedies are reduced, while the materials on Chapter 11 are expanded. New chapters deal with single asset real estate bankruptcy cases, compare workouts with Chapter 11, survey the liability of third parties such as sureties, insiders and issuers of letters of credit and examine the liability of lenders to the debtor, to other lenders, and to the government under a variety of theories ranging from breach of participations agreements to environmental accountability. David Epstein has taken full advantage of his practice experience to include throughout the book pleadings and other documents that provide opportunities for students to understand and questions the application and operation of bankruptcy law. Similarly, Steve Nickles has drawn on his service on the Article 9 Review Committee to add materials on new kinds of collateral and new forms of financing.
