Dear Nu-Co,
On Oct. 18, 2006 your company installed brand new windows in the second floor of my home at 46, rue de Shediac in Kirkland. You also removed clamps that used to hold my air conditioners and you did not seal the holes with exterior calking. I sent you a letter back in February, asking that you come by and repair the damage that was caused by your company’s workmanship.

You came by in April and claimed that the damages were not caused by your company. I had to hire a renovation company, called Precise Renovation, to come and assess the damage and repair it. They ascertain that the damage was caused by your company and they have listed the reasons for the damage on their invoice.

It cost me $1,602.15 to repair the damages caused by your company. I have included a copy of the invoice that I paid to Precise Renovation for these repairs. I have also included a copy of our contract and the letter that I sent to you in February.

This letter constitutes formal notice to pay me the sum of $1,602.15 by Wednesday, August 22, 2007. Otherwise, I will take legal action against you without further notice.

Note: After receiving this letter Abe Katz threatened to counter sue me if I sued him. On Thursday, November 22nd we had freezing rain and we noticed water on the floor in my son's bedroom. We removed the gyproc around the window and the tentex was soaking wet all around the window. This means that another window is leaking. I called Abe Katz and asked him to come and see the damage and repair it. He said that he would come on Friday or Saturday. After not showing up either day I called him Sunday morning, November 25th and asked him where he was. He said he was busy and that he would come by on Monday, November 26th. Since he did not come I registered Complaint # 98324 with the "Office de la protection du consommateur". I faxed it to him at 8:45 PM on Monday, November 26th. This complaint states that he has 10 days in which to repair the window which is leaking.
On Tuesday, November 27th he showed up at 7:15 AM with a friend of his. He said that he would send one of his employees by to fix it. On Thursday afternoon I called him and he said he would come on Saturday, December 1st with one of his employees to fix my winodw. He said he would put aluminum flashing above the window, which he should have done in the first place but never did do. He also said he would calk around the window and put new insulation around the inside of the window. I asked him if he could come on Friday or Monday instead of Saturday because I like to enjoy my weekends with the family. He said that he was only available Saturday at noon. So I waited for him all day Saturday and he never showed up. I called him at 5:45 PM on Saturday, December 1st and asked him why he did not show up. He said that it was because it was too cold and the calking wouldn't stick. I asked him why he did not have the common courtesy to call me and let me know that he would not be able to come by and he said that I should have known that it was too cold for him to do the repair work. I am not sure how I would know this since I am not a renovation expert. He then said that he would come by on Monday, December 3 or Tuesday December 4 to fix the leaky window. He has complete disregard for his customers.
I have a feeling that Abe Katz is trying to stall me and frustrate me in the hopes that I will give up but I will not so so. Tuesday, December 4th, 2007, Abe Katz arrived at my house with 1 of his employees named Vasil. It amazed me that he needed to borrow my ladder to get to the outdoors of the upstairs window. He also needed to borrow a kitchen knife in order to put some insulation around the window. He also needed to borrow a step ladder to put the insulation in around the window inside the house. It begs the question, what kind of renovation company does not have their own tools?
Several areas around the window were not calked properly and we could see the light coming in right between the window and the wall. Of course, he said that water could not possibly be coming in from those areas. As we all know, water will come in from any hole it can find. He put a little bit of calking in two areas and claimed that the leak was coming from my roof. If this is the case, then why is their only water coming in two areas under the window as we can see in this picture.
